Terms of Service

1. Acceptance

By accessing or using Polario ("the Service"), operated by Challenger Corporation USA, S.A. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

Polario is an AI-powered image editing tool that removes unwanted elements such as text overlays, logos, date stamps, and other visual artifacts from images. The Service is provided as a tool licensed solely for editing content you own or are authorized to edit.

3. User representations and warranties

By using the Service, you represent and warrant that:

• You own the images you upload, or you have obtained all necessary rights, licenses, and permissions from the rightful owner to edit them
• Your use of the Service does not violate any applicable law, regulation, or third-party right
• You will not use the Service to infringe upon any person's or entity's intellectual property rights, including copyrights, trademarks, or rights of publicity
• The output images you create will be used in compliance with all applicable laws

4. Prohibited uses

You may not use the Service to:

• Remove, alter, or obscure any copyright management information (as defined under 17 U.S.C. § 1202 and equivalent international laws) from content you do not own or are not authorized to modify
• Remove copyright notices, attribution, or authorship information from others' creative works
• Create, distribute, or facilitate the distribution of content that infringes third-party intellectual property rights
• Upload illegal, obscene, defamatory, or harmful content
• Circumvent rate limits, abuse the Service, or interfere with its operation
• Use automated scripts, bots, or other tools to access the Service in an unauthorized manner

5. DMCA and copyright acknowledgment

You acknowledge that removing watermarks, copyright notices, or other forms of copyright management information from content you do not own may constitute a violation of the Digital Millennium Copyright Act (17 U.S.C. § 1202) and similar laws in other jurisdictions. You accept full responsibility for ensuring your use of the Service complies with all applicable copyright laws. The Service is not intended to facilitate copyright infringement.

6. Credits and payments

• New accounts receive 1 free credit upon registration
• Additional credits and subscriptions may be purchased through Apple App Store (iOS), Google Play Store (Android), or Paddle (web)
• In-app purchases are subject to the terms and refund policies of the respective platform (Apple, Google, or Paddle)
• If processing fails due to a system error, your credit is automatically refunded
• Credits do not expire unless your account is terminated for violation of these Terms

7. Content moderation

All uploads are automatically scanned for inappropriate content using AI-based content safety systems. Images flagged by our moderation system will be rejected and your credit refunded. Repeated violations (three or more) will result in automatic account suspension.

8. Image handling

Input images are processed server-side and deleted promptly after processing. Output images are automatically deleted within 1 hour. We do not store, review, train on, or use your images beyond processing your request. See our Privacy Policy for complete details.

9. Indemnification

You agree to indemnify, defend, and hold harmless Challenger Corporation USA, S.A., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you upload to or generate using the Service.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that image editing will produce perfect results for every image. Results depend on the characteristics of the input image. AI processing is not 100% accurate. We make no warranty regarding the quality, accuracy, or reliability of any output.

11. Limitation of liability

To the maximum extent permitted by applicable law, Challenger Corporation USA, S.A. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, regardless of the theory of liability. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Account suspension and termination

We may suspend or terminate your account at any time if you violate these Terms, including but not limited to: uploading prohibited content, abusing the Service, or circumventing our systems. Upon termination, any remaining credits are forfeited.

13. Changes to terms

We may update these Terms at any time. Material changes will be communicated through the Service. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Panama, without regard to its conflict of law provisions.
